3510 ARTICLE 16.

the manner of disposing of offal and waste products, except sewage, gar-
bage, refuse and ashes, provided, that such ordinances may apply to any
portion of said district, and be it further provided, that the power of the
County Commissioners to inspect, license, regulate and limit as to location
club houses shall not apply to the club houses of county clubs within the
District which were in existence and operation on January 1, 192Y, and
which on that date had a public or private list of fifty or more bona fide
members paying dues and which on that date maintained on the club
premises at least two of the following athletic facilities for their mem-
bership, to wit:

1. A golf course of nine holes or more,

2. Two or more tennis courts, or

3. A swimming pool not less than 40 feet in length and 20 feet in
width.

For the purpose of carrying out the powers conferred upon them by this
bill or for the protection of the health, safety, comfort or morals of the
community or for the purpose of the inspection, licensing, regulation or
limitation mentioned in this section any agent of the Board designated as
such shall have the right to enter at all reasonable hours upon any private
premises or into any building in the district. Any restraint of hindrance
offered to such entry by any owner or tenant or agent of said owner or
tenant shall be a misdemeanor punishable under Section 641 of this
subtitle.

For the purpose of carrying out any power or discharging any duty
conferred upon them by this Act the County Commissioners are hereby
authorized to pass such rules, regulations or ordinances as they may from
time to time deem necessary. The County Commissioners are hereby
authorized to provide in such rules, regulations or ordinances that any
person who violates the provisions of the same shall be guilty of a mis-
demeanor and upon conviction before the Police Justice of Montgomery
County shall be fined not more than $50.00 (fifty dollars) for each viola-
tion, and the County Commissioners may also provide that in default of
the payment of any fine imposed as herein provided the offender may be
Imprisoned for a period not to exceed 30 days, provided that no ordinance
shall be adopted except by a yea and nay vote and the names of the mem-
bers of the Board of County Commissioners voting for and against the
same shall be entered in the minutes of the said Board.

631. The two members of the Board of County Commissioners elected
from the Commissioner Districts Four and Five shall maintain daily
office hours during which they shall be in personal attendance at the Coun-
ty Buildings which may be established by the Board of County Commis-
sioners within their respective Districts. The said Board is hereby au-
thorized and directed, upon the recommendation of the County Commis-
sioner representing the Fourth County Commissioner District, to appoint,
discharge at pleasure and fix the compensation of a Deputy Clerk to the
