the said Mayor and Town Council shall require a surety company bond
in the penal sum to be fixed by them, the same to be given by the successful
bidder or bidders for the faithful performance of the contract and the
payment of all material, material men, laborers and employees of any
contractor or contractors engaged in the performance of said work, the
said bond to be approved, in writing, by the Mayor of said town.

537. The said Mayor and Town Council of the Town of Kensington
are hereby authorized and empowered to contract for and purchase, in
fee simple, or lease for a term of years renewable at their pleasure, and
to use and occupy the same, any land, real estate, private water and sewers
mains, pipes and conduits, wells or streams which they may deem exper
dient and necessary for the purpose of establishing and constructing, and
in the maintenance, of said water and sewerage system. If for any cause
the said Mayor and Town Council shall be unable to agree with any owner
or owners of real estate or leasehold property, wells, streams, private
water and sewer mains, pipes and conduits, or for any right-of-way, or
any other material which partakes of or is a necessary part of realty,
which they may find necessary for the establishment and construction of
said system, or for the conduit of water into and of water and sewage in
and from said town, or if such owner is under any disability or incapacity
to contract, or is absent from the County, or unknown, the said Mayor
and Town Council of the said Town of Kensington are hereby clothed
with the power of condemnation, under the right of eminent domain, aa
provided in Sections 331 to 337, inclusive, of Article 23 of the Code of
Public General Laws of Maryland, as fully as if said Sections had been
herein incorporated, and the manner of procedure of condemnation for
the purposes of this Act shall be in all particulars the same as provided
by the aforesaid Sections and Article of the Public General Laws of
Maryland.

538. The title to said Water and sewerage system, all land, water
courses, waterways, wells, conduits, pipes, mains, machinery, buildings and
all other parts thereto shall, when completed or acquired, vest in the Town
of Kensington, a municipal corporation; and the Mayor and Town Coun-
cil of the Town of Kensington shall have the power to fix schedules of
rates for furnishing water and sewerage facilities to private residences,
and other buildings in the said Town of Kensington, the income thereof
to be applied for maintenance of said system, said charges therefor to be
payable as other town taxes are payable and be a lien upon the real estate
against which it is levied; and, in their discretion, contract with any per-
son outside the corporate limits of said town to furnish water and sewer-
age facilities, or either; the said Mayor and Town Council are further-
more fully authorized to pass all necessary ordinances, with penalties for
