under the laws of this State, to the State of Maryland, in the penalty of
an amount equal to the amount of taxes to be placed in his hands for the
next ensuing year, as estimated by the County Commissioners, with the
condition prescribed in Section 51 of Article 81 of the Code of Public
General Laws of this State relating to the bonds of collectors of State
taxes, and also a bond to the State of Maryland, executed as above pro-
vided, in the penalty of $50,000, conditioned for the faithful performance
of his duties as treasurer of Montgomery County; said bonds shall be ap-
proved by the County Commissioners of said county, and new bonds shall
be given for each year that he shall hold office; provided, that after the
first year of his encumbency said bonds may be executed and delivered
at any time before the annual levy of taxes is placed in his hands for col-
lection, and all such bonds shall be recorded in the office of the clerk of
the Circuit Court for Montgomery County, and the commissioners of said
county shall require as surety upon such bonds a surety or guarantee com-
pany incorporated under the laws of this State, and the said County Com-
missioners shall levy such sums as may be necessary to defray the expenses
thereof.

201. In case the person so elected shall die, remove from the county
or for any reason fail to execute the bonds required by the preceding sec-
tion on or before the day prescribed for his entering upon the duties of
his office, the County Commissioners shall, as soon as possible declare said
office vacant, and in a reasonable time proceed to fill the same by appoint-
ment of a suitable person possessing the qualifications herein prescribed,
who shall serve for the term for which the person so elected was elected.
In the event of the death, removal from the county, or removal from office
of the Treasurer, the County Commissioners shall in like manner declare
the office vacant and, within a reasonable time, fill the same for the re-
mainder of the term. That in the event of a vacancy in the office of the
County Treasurer, the County Commissioners are authorized and empow-
ered to designate one of the Assistant County Treasurers hereinafter pro-
vided for in Section 203, hereof, as Acting Treasurer and the said Assist-
ant so designated shall forthwith enter upon and perform any and all
duties now performed by the Treasurer, provided that such designation
and appointment shall continue only for such period as the office of County
Treasurer shall remain vacant.

202. He shall perform all the duties now by law required to be per-
formed by said Treasurer, or which may be required of him by any future
law. He shall receive as compensation for all his services as Treasurer an
annual salary of three thousand dollars, to be paid monthly, which said
sum shall be in lieu of all fees and commissions.
