67. The commissioners shall not expend or contract to expend, in any
one year, more money than the amount receivable from taxes and other
sources for that year.

68. The commissioners for the county, justices of the peace, sheriff,
constables and all State and county officers shall have, hold and exercise
their offices and jurisdiction in said town as if this charter had not been
granted; and the commissioners of Montgomery county shall annually pay
to the commissioners of Brookeville a sum equal to all taxes levied for the
repair of roads upon the real property in said town, to be used on the
public streets of said town for the maintenance and repair thereof.

69. The commissioners shall have power to establish the original build-
ing lines on all the streets in said town as far as practicable without re-
moving present buildings; to establish building lines on any streets here-
after opened, and to compel all persons erecting buildings in said town to
conform thereto.

70. The parts of .the several county roads within the limits of said
town are hereby made and declared to be public streets or avenues of
said town, and shall be from time to time improved and repaired as in
the discretion of the commissioners the public interests may require and
the resources of the town will justify; but this section shall not be con-
strued as interfering in any manner with the rights of the Brookeville and
Washington Turnpike Company in maintaining their road through said
town; provided, however, that the commissioners may lay sidewalks along
said turnpike road in such manner as not to impede or obstruct the proper
use thereof by said company.

71. Neglect or non use shall not work a forfeiture of this charter.

72. All persons, firms or corporations shall before erecting, construct-
ing, or re-modeling any building in said Montgomery County where the
actual cost of such construction or re-modeling shall exceed the sum of
three hundred dollars, said person, persons, firm or corporation shall make
application to the clerk to the County Commissioners for a permit to
erect, build, re-construct or remodel any building within the limits of said
county. The application for the permit to build shall set forth in detail
the location of the land and the size and approximate cost of the building.
