316 ARTICLE 1A.

nated part thereof, or for lessening the danger of or damages from floods
in said District or any designated part thereof, which said plan, when
adopted, shall be known as "The Partial Flood Prevention Plan." Said
Plan shall include such maps, profiles, blue prints and other data and

descriptions as may be necessary to set forth the location and character
of the work and of the property benefited or taken or damaged, or other-
wise affected, with estimates of the cost, and specifications for doing the

work.

119. Said Mayor and City Council shall also take into consideration

whether or not other parts of Cumberland not included within said Will's
Creek Flood District have heretofore been or may hereafter be in danger
from floods from the waters of the Potomac River, and are authorized
and shall prepare plans for the prevention of such floods, and may employ

engineers and counsel for the purpose of preparing and completing such
plans, and preparing such legislation and agreements as, may be required
to put such plans into effect, which said plan shall be known as "The
Permanent Flood Prevention Plan."

120. When said Will's Creek Flood District has been established and
said Partial Flood Prevention Plan has been adopted as heretofore pro-
vided for, all property included in the part of said District designated
by said Partial Flood Prevention Plan, or all property in said District
if the whole of said District is included in said Partial Flood Prevention
Plan, shall be conclusively presumed to be benefited by the carrying ont
and putting into effect of said Partial Flood Prevention Plan, unless it
be shown that there was fraud or collusion in the adoption of said Plan.

121. The said Mayor and City Council shall have full power and au-
thority to devise, prepare for, effect, maintain and operate any and all
works or improvements necessary or desirable to complete, maintain,
operate and protect the said Partial Flood Prevention Plan. They may
secure and use men and equipment under the supervision of an engineer
employed for that purpose, or other agents, or they may, in their dis-
cretion, let contracts for such work, either as a whole or in parts.

122. Said Mayor and City Council of Cumberland, or their employees

or agents, including contractors and their employees, and the members of
the Commission hereinbefore referred to, and their assistants, agents and
employees may enter upon lands within the limits of the City of Cum-
berland or a mile beyond said limits in order to make surveys and exam-
inations to accomplish the preliminary steps or parts or purposes of said
Partial Flood Prevention Plan, and shall have access to the work needed
