1916, ch. 680, sec. 361. 1916, ch. 199, sec. 189.

353. Any person who has been a bona fide resident of Havre de Grace
for the period of three years next preceding the application hereinafter
provided for, who shall desire to take out a license for the sale or barter
of spirituous or fermented liquors, in any quantity whatsoever, shall file
with the Clerk of the Circuit Court for Harford County a petition in
writing, signed by himself and at least five freeholders who have been
such f or a period of two years prior to the time of so signing and resident
for a like period of two years within the corporate limits of said city;
and the said petition shall certify that the said applicant is a proper
person to be licensed, and pray that license may be granted to such appli-
cant, and said person applying for license shall also file with said Clerk
a bond duly executed to the State of Maryland, with at least two sureties
approved by the said Clerk, in the penal sum of two thousand dollars con-
ditioned for the payment of any or all fines, penalties and costs to which
the person obtaining such license may become liable by reason of the vio-
lation of any of the provisions of this Article; and each surety on said
bond shall make affidavit before said Clerk or before a Justice of the
Peace or Notary Public of said County, that said surety is the owner in
fee simple of real estate in Harford County of the assessed value, over
and above all encumbrances, of at least two thousand dollars, and that
said surety has not within the current year executed a bond for any other
applicant to sell spirituous or fermented liquors in said city, and no per-
son other than the one who has been a resident of Havre de Grace for the
period of three years next preceding his application for license, as here-
inbefore mentioned, shall be permitted to receive a licnse to sell spirituous
or fermented liquors in said city. And said applicant shall within ten
days after the filing of said petition with said Clerk cause to be published
in some newspaper printed and published in the city of Havre de Grace,
a notice setting forth that he or they have made application to the Clerk
of the Circuit Court for said County for a hotel liquor license in the City
of Havre de Grace, in accordance with the provisions of this Act.

Before said Clerk shall issue a license to the applicant therefor, there
shall be filed with him a certificate of publication from the publisher of
the paper in which the aforesaid notice was published, stating that the
6aid notice has been published in accordance with the provisions of this
section; which certificate of publication shall be filed with the Clerk of
the Circuit Court for Harford County within thirty days from the date
of the filing of the applicant's petition for license.

354. The Clerk of the Circuit Court may in his discretion require such
further and other proof, by the written affidavit of other parties, to be
filed in his office; as to the sufficiency of said bond, as he may deem
proper; and if said Clerk shall wilfully or negligently grant a license to
any person who shall not have complied with the provisions of said sections
of this subtitle of this Article, said Clerk shall, upon indictment and con-
