2810 ARTICLE 12.

could do in such case if they were tried before said court without the
intervention of a jury; provided, however, that if any person, when
brought to trial, or if the State's attorney for said county shall pray a
jury trial for the alleged offence, on the part of the State, it shall be the
duty of said justice of the peace to commit such offender for trial, or hold
him to bail to appear for trial at the then term of the circuit court, if
it be in session, and if not, to the next term, and to return the commit-
ment or recognizance, with the names and residence of the witnesses for
the prosecution endorsed thereon, forthwith to the clerk of said court;
and it shall be the duty of said justice of the peace to inform the person
charged, of his right to a trial by jury in all cases.

LIVERY STABLES.

338. All persons or firms engaged in the livery, sale and hiring busi-
ness in Garrett county shall be required to take out a license therefor from
the clerk of the circuit court; the amount of said license shall be twenty
dollars, the whole of which shall be paid over by said clerk to the county
commissioners, to be by them applied to the public road fund; and for
-each license so issued the clerk shall be entitled to charge and receive one
dollar.

339. Any person or firm who shall carry on such business without such
license shall be deemed guilty of a misdemeanor, and upon indictment and
conviction in the circuit court shall be fined not less than fifty nor more
than one hundred dollars.

LOCH LYNN HEIGHTS.

1896, ch. 450, sec. 1.

340. The citizens of the town of Loch Lynn Heights in Garrett County

be and are hereby created a body corporate by the name of the Mayor
and Council of Loch Lynn Heights, with all the powers and privileges
of a body politic and corporate, and by said name may have perpetual
succession, sue and be sued, plead and be impleaded in any court of law
or equity and may have and use a common seal.

341. The corporate limits of said town shall be as follows : Beginning
for the same at the southerly limits of the Baltimore and Ohio Railroad
Right of Way and the easterly margin of the road known as the Wonderly
Road, and at a point on said road which is North 71 degrees.

1. South 7 degrees East, 76 and 8-10 feet; thence

2. South 70 degrees East, 245 feet; thence

3. South 39 degrees and 45 minutes East, 714 feet; thence

4. South 42 degrees and 45 minutes East, 993 feet"; thence
