P. L. L., 1888, Art. 12, sec. 22. 1878, ch. 108.

34. All fines and forfeitures under the ordinances of the said corpora-
tion shall be recoverable as small debts are recoverable before any justice
of the peace.

35. The limits of said town shall extend to the distance of one-half
mile each way from the public well in said town.

36. The commissioners shall have full power to make all such by-laws,
regulations and ordinances, not inconsistent with the constitution and laws
of this State, as from time to time they may deem necessary and expedient
for the comfort, health, convenience and prosperity of said town and its
inhabitants; for the prevention and removal of nuisances; preservation of
health and suppression of vice and immorality within the limits of said
town; and they shall have power to lay an equal tax upon the property
within the said limits, to such an amount as may be deemed necessary to
accomplish the purposes aforesaid, which tax shall be collected and paid
to the president and commissioners by the collector appointed by them,
who shall have the same power to distrain therefor as the collector of pub-
lic county taxes has to distrain for county taxes; and they shall fix the
term of office, amount of bond and compensation of such collector.

37. They shall have full power to appoint, annually, a bailiff, whose

duty it shall be to preserve the peace and good order of said town; and
for this purpose he is invested with the same power and authority that

constables have under the laws of this State.

38. Said corporation shall not issue any device, certificate, or evidence
of debt to be used as currency.

39. The County Commissioners of Allegany and Garrett Counties are
hereby authorized and empowered to employ a competent and skillful civil
engineer, not a resident of either county nor owning property therein, to
survey and accurately locate the boundary or division line between the
said counties of Allegany and Garrett in accordance with the provisions
of the Act of eighteen hundred and seventy-two, chapter two hundred
and twelve, of the laws of Maryland relating thereto.

40. Each board of county commissioners shall have an equal voice in
the selection of said engineer, and may act in joint meeting or by separate
