required, conditioned, for the faithful performance of his duty of the
office of clerk and bailiff, respectively, and the said bond shall be recorded
in the office of the Circuit Court for Frederick County.

670. The Council shall receive any election returns and determine all
questions arising thereon and any person conceiving himself aggrieved
by reason of such determination may appeal to the Circuit Court for
Frederick County, which shall hear and determine the same, and deter-
mine who shall pay the costs of appeal; in case of a tie in any election
for burgess and councilmen, another election shall be held after ten days'
notice, pursuant to the provisions aforegoing in regard to elections; in
case of vacancy in the office of burgess or councilmen by death, resigna-
tion or removal from town, said vacancy shall be filled by a vote of the
Council, until the next election for members of the Council.

671. The Council shall have power to pass all ordinances necessary
for the good government of the town, may open, close and widen the streets,
lanes and alleys; prevent, remove and abate, or cause to be removed or
abated all nuisances or obstructions in or upon the sidewalks, streets, high-
ways, lanes or alleys, drains or water courses, or in, or upon any lot
adjacent thereto, and to provide for imposing a fine upon any person,
causing, creating or maintaining any such nuisance or obstruction; to
remove or cause to be removed houses or other structures or objects that
may be dangerous to property, health or persons passing along, or over
any of the highways of the town, or residing in the neighborhood thereof;
to make reasonable regulations in regard to buildings to be erected in
said town; to make, and establish grades upon the streets and highways
of the town; to cause sidewalks along the public streets and highways of
said town to be graded, paved, repaired or made, curbs to be set, and
gutters to be laid, to cause the water-courses, drains or sewers to be paved,
kept in repair and cleaned, to control and protect the public grounds, and
property of the town; to establish and regulate a station house or lock-up
for the confinement of the violators of the laws and the ordinances of the
town; provided, that the county jail shall be used for such purpose until
said council shall deem it advisable to establish and regulate said station
house or lock-up; to levy a tax, and impose a license on dogs or other
animals running at large; to prevent horses, cattle and swine running at
large in the streets of said town; and to regulate and control all offensive
trades, manufacturers and traffic in offensive fertilizer or other commodi-
ties; and for the purpose of carrying out the foregoing powers, and for
the preservation of cleanliness, health, peace and good order of the com-
munity, and for the protection of the lives and property of the citizens
and to suppress, abate or discontinue or cause to be suppressed, abated
or discontinued all nuisances within the corporate limits of the said town,
they may pass all ordinances or by-laws from time to time necessary, and
