544. AH fines, forfeitures and penalties under the ordinance of the cor-
poration, shall be recoverable before the Burgess or any one of said Com-
missioners, or before any justice of the peace of Frederick County, in
the same manner as small debts; and any person refusing to pay such
fines or forfeitures shall be committed to the jail of Frederick County
until payment or discharge iu due course of law; and each of said com-
missioners shall, in virtue of his office, have and exercise all the powers
of a justice of the peace, in so far as the recovery of said fines and for-
feitures is concerned, and may commit to jail for non-payment thereof;
and all moneys so collected shall be pai.d over to the register.

545. The Burgess may commit any vagabond or vagrant who may be
found wandering about the streets of said town to the almshouse of the
county.

546. The said Burgess and Commissioners may, by ordinance prohibit
the running at large in said town of any horses, cattle, sheep, swine or
geese.

547. The Burgess and Commissioners may erect and maintain a public
building for the purposes of the municipal business and for the accommo-
dation of the fire apparatus of the town, and they shall have power to
acquire by purchase or by condemnation in the manner provided for by
Code of Public General Laws, Article 23, Sections 167 to 173,* inclusive,
so far as the same may be applicable, so much real estate as may be neces-
sary for the erection of such building, and the said Burgess and Com-
missioners may likewise purchase any building already erected for the
purpose of municipal business, and for the accommodation of fire appa-
ratus of the town, and for a town hall, upon such terms and at such
prices as may be fair and equitable in. the judgment of the said Burgess
and Commissioners. And the said Burgess and Commissioners shall have
the power to issue bonds in a sum not exceeding three thousand dollars
($3,000) payable on or before fifteen (15) years after date, bearing in-
terest at a rate not exceeding five per cent. (5%) per annum, the terms
and conditions and the rate of interest on said bonds to be prescribed by
ordinance, duly passed by the Burgess and Commissioners of Middle-
town, and providing that before any bonds are issued under the provisions
of this section, the question of the issuance thereof and the purposes for
which the same are to be issued shall be submitted to the qualified voters
of said town, either at the annual election or a special election called for
the purpose, and the said issue of bonds be approved by a majority of
the qualified voters of said town voting at said election. And the Burgess
