to fill such vacancy or vacancies. And provided, further, that whenever
any vacancy or vacancies shall be filled under the terms of this proviso,
that is to say by appointment instead of by election, the person or persons
so chosen to fill such vacancy or vacancies shall be of the same political
party as the Alderman or Aldermen whose place or places is or are so to
be filled.

CITY CONSTABLES.

221. The Mayor shall appoint such number of city constables or police-
men as may from, time to time be provided by ordinance, who, within the
police limits of the said city, shall have all the powers possessed by Con-
stables in this State, except as to the collection of debts, and shall perform
such duties as may be prescribed by ordinance, and shall not be entitled to
any fees, costs or other emoluments; all other officers of the corporation
not herein named, who shall be deemed necessary to execute the laws and
ordinances of the corporation whope officers are now or may hereafter be
provided for by law or by ordinance, order or resolution of the Board of
Aldermen, shall be appointed by the Mayor, at the usual time of making
appointments or at such time as the ordinances may prescribe, and they
and all officers herein named shall receive such compensation as shall be
fixed from time to time by the ordinances of the corporation, and the
Mayor shall have the power and authority to remove from office any city
constable or other officer who may be found inefficient, incompetent or
incapable, or who may be guilty of any misconduct or malfeasance in
office, or who is negligent in the performance of his duties.

222. The appointment of all officers provided for in the next preceding
section shall be subject to confirmation by a majority vote of all the
members elected to the Board of Aldermen, provided the members of the
Board of Aldermen shall take action on such appointments within the
first two regular succeeding meetings of the board after such appoint-
ments are made and the name or names are sent to the board by the
Mayor. If the said board fails to take; such action within said time, then
the person or persons so appointed by the Mayor shall be to all intents
and purposes such officer or officers as if they had been confirmed by said
board. If the said board by a majority vote within the prescribed time
shall refuse to confirm such appointments, the Mayor shall appoint other
person or persons to fill such office or offices and notify the Board of
Aldermen thereof at their next regular meeting, -and which new appoint-
ments shall also be subject to confirmation as aforesaid. All officers of the
corporation shall be entitled to hold their respective offices until their
successors are duly appointed and qualified. All persons appointed to
any official position by the Mayor shall, before entering upon the dis-
