2340 ARTICLE 10.

and shall be liable to prosecution at the instance of the county road engi-
neer of Dorchester County or at the instance of any taxpayer of said
county, and upon conviction by any justice of the peace exercising crim-
inal jurisdiction in Dorchester County shall be fined in an amount not
less than five dollars, and not more than fifty dollars for each offense.
Any person arrested tinder this section shall have the right of appeal to
the Circuit Court for Dorchester County, and all fines collected under
this section shall be paid to the County Commissioners and by them ap-
plied to the general road fund of the county.

465. That the County Road Engineer of Dorchester County shall, on
or before the first day of June, 1912, and on or before the first day of
April in each year thereafter, make up a schedule of the public -roads
and bridges to be worked, repaired or rebuilt during that year, and the
extent of the work and repairs to be done thereon, and present the same
to the County Commissioners for their approval or rejection, in whole
or in part, and the said Commissioners may from time to time add to
said schedule any road, roads and bridges not included in saul engineer's
report that are to be worked, repaired or rebuilt during the year in their
respective commissioner districts; the total amount of such schedule not
to exceed seventy-five per cent, of the amount levied for such purposes,
the remainder of twenty-five per cent, of the said road levy to be kept in re-
serve for use in making temporary repairs to any and all other roads and
bridges in said county as the safety and convenience of public travel may
require. And provided further, that nothing in this act shall be taken
or construed to interfere with or relate to any contract work of any of
the roads or bridges in said county now or hereafter to be entered into
by said Commissioners.

466. That at all times while the teams and road equipment are engaged
in the regular road work they shall be under the exclusive control and
management of the county road engineer, but at all times when the team
is not working they shall be under the control and management of the
County Commissioners; and it shall be the duty of the county road engi-
neer to submit to the County Commissioners for their information the
price of all bridge and road material recommended by him to be pur-
chased for use in the repair or rebuilding of the roads and bridges, as
hereinbefore provided to be repaired and rebuilt, before same shall be
purchased by the County Commissioners, and also the quantity, price and
quality of food required for the teams. It is expressly understood that
all materials, supplies, feed, equipment, etc., for use on the county roads
and bridges are to be purchased by the said County Commissioners, and
same shall be inspected and passed upon, and all bills certified as correct
by the said county road engineer before being paid.
