423 to 432, inclusive, the penalty for which is not otherwise provided for,
shall upon conviction thereof before a justice of the peace or judge of the-
Circuit Court for Dorchester County, upon indictment by the grand jury,
be fined not less than fifty dollars nor more than one hundred dollars, or
shall be imprisoned in the House of Correction for not less than three
months nor more than six months, or shall be both fined and imprisoned
in the discretion of the court or justice trying the same; and in the event
of a fine being imposed, the party shall stand committed until the fine and
costs are paid; provided, that before a justice of the peace shall proceed
to try any case under said sections, he shall require the person charged
with such violation to make his election either to be tried before said jus-
tice or before the Circuit Court for Dorchester County, and said election
shall be entered upon the record of the said justice; if he elects to be tried
before the circuit court, he shall be required to give bond with approved
security to the State, in double the amount of the fine named for said
offense, for his appearance at the first term of said court held in said
county; if any one or all of such defendants shall elect to be tried before
said justice of the peace, the justice shall proceed to docket the case in
usual form, and hear and decide the same.

429. The master of said boat shall have painted in black figures on
two sets of white canvas, the numbers corresponding to the license to catch
oysters; each figure shall be ten or more inches long and of proportionate
width, and at least four inches apart, one of which the master shall have
firmly sewed upon the starboard side and near the middle of that part
of the mainsail which is above close-reef; and the other number on the
port side and near the middle of the jib, above the bonnet and reef; these
numbers shall be placed in an upright position and worn at all times
during the dredging season, and shall not be concealed or defaced, and
no other number shall be used or exposed to view except the true
number on said license; and any person who shall violate the provisions
of this section shall be deemed guilty of a misdemeanor, and upon con-
viction before any justice of the peace in the county, or judge of the circuit
court, shall be fined not less than twenty-five dollars nor more than fifty
dollars, and stand committed until costs and fines are paid; and all fines
arising from any violation of Sections 423 to 432, inclusive, shall be
paid by the defendant, to the justice of the peace trying said case, or to the
sheriff of said county, or his deputy, and by them shall be paid into
the public school fund of said county; and a failure by the said justice,
sheriff or his deputy to pay said fine within thirty days after receipt of
the same, to the public school fund, shall be deemed a misdemeanor, and
shall subject said justice, sheriff or deputy, to a fine double the amount
received by them, to be recovered by indictment or suit.

430. The School Commissioners, before the fifteenth day of September
of each year, shall furnish to the clerk of the circuit court the requisite
