of this Act, he shall be deemed guilty of a misdemeanor, and upon con-
viction thereof before a justice of the peace or the Circuit Court for Dor-
chester County, shall be fined not less than one hundred dollars for each
and every offense, and stand committed until such fine and costs are paid.

426. The managing owner of such boats shall make oath or affirmation
before the clerk of said court that he is a bom fide managing owner of
such boat described in the license; that he has been a resident of said
county for the period of one year next preceding the application; that the
boat is owned wholly by residents of said county; that there is no lien,
interest or claim on said boat held by a non-resident of Dorchester Coun-
ty; that the said boat is not held with intention to violate any provisions
of this sub-title of this Article; that said boat has been owned in whole by
residents of said county the six preceding months, if it is six months old,
and the said master of said boat shall also make oath before said clerk
that he has been a resident of said county for twelve months next preced-
ing the time of taking said oath, and that he will comply with all laws,
general or local, regulating the catching of oysters, and at the time of
taking such oath he shall exhibit to the clerk the custom-house license of
the said boat, if five tons or more gross tonnage, and also the certificates
of the admeasurers of all boats whose gross tonnage, by the rules of
custom-house measurement, are, as shown by said custom-house license,
to be in excess of six tons gross measurement.*

427. Any master or person in charge of any boat, canoe or vessel, who
shall take or catch oysters in the waters of said county with scoops or
dredges, without first having obtained license as provided in the preced-
ing sections, or any managing owner who shall fraudulently obtain such
license, shall be deemed guilty of a misdemeanor, and upon conviction
before a justice of the peace or judge of the circuit court for said county,
shall be fined not less than one hundred dollars nor more than two hun-
dred dollars, and stand committed until fine and costs are paid, or be im-
prisoned in the house of correction for a period of not less than three
months nor more than one year.

428. Any person who shall use any boat, canoe or vessel to catch oysters
with scrapes or dredges in any of the waters of said county not authorized
by section four hundred and twenty-three of this Article, as amended by
Chapter 456 of the Acts of eighteen hundred and ninety-four, or refuses
to exhibit the custom house or dredging license whenever called for by any
officer of the State of Maryland, or for catching oysters before the season
commences or after it has closed, or for any other violation of Sections
