412. The proceeds of sale of property condemned, and all fines im-
posed and collected under the provisions of the three preceding sections,
after paying the costs and expenses of arrest, seizure, condemnation and
sale, shall be divided and paid over, one-fourth thereof to the sheriff or
constable making the arrest; one-fourth thereof to those aiding in making
the same, and the remaining half thereof to the board of County School
Commissioners, for the use of the public schools of the county.

413. Any party against whom any justice of the peace shall render a
judgment under the provisions of Section 411 may, at any time within
twenty days from the rendition thereof, appeal from such judgment to
the circuit court for said county; but no execution or sale shall be stayed
unless the party appealing shall give bond to the State of Maryland in
double the amount of the fine imposed or value of the property condemned,
with security to be approved by the said justice of the peace, with condi-
tion to prosecute such appeal with effect, and to pay the parties, entitled
to the same the value of the property condemned or amount of fine im-
posed, and all costs attending such proceeding, in case, judgment shall be
affirmed; and in all cases of appeal under the provisions of this section
either party shall be entitled to trial by jury.

414. The Clerks of the Circuit Courts for Talbot and Dorchester Coun-
ties, respectively, shall, upon application of the managing owner, who
has been a resident of the county in winch he shall apply for one year
next preceding such application, and to no other person, issue a license
to such resident to employ his boat, of a capacity of seven gross tons or
under, such capacity to be ascertained by rules of the custom-house
measurement, as hereinafter provided, in taking and catching oysters with
dredge, scoop or scrape in the waters of the Choptank River, in said
counties, for sale from the first day of November and the fifteenth day
of March next succeeding, both inclusive, on which last named day the
license shall expire; provided, that nothing in this section shall authorize
the taking of oysters with scoop, scrape or dredge above a straight line
drawn from the long wharf at Cambridge, known as Thomas' Wharf, on
(he Dorchester shore, to the Bawdle House on the Talbot shore, imme-
diately opposite, or in any tributary of said river, above or below said
line; provided further, that the applicant shall pay such clerk the sum
of one dollar and ninety cents per gross ton, according to the capacity of
the vessel to be licensed, which capacity shall be determined by gross
tonnage; and all boats measuring less than five tons gross shall pay eight
