non-residents of the State of Maryland, and whether infants or adults,
and whether non compos mentis or of sound mind, by publication of said
notice in some newspaper published in Cecil County once a week for three
successive weeks warning them to appear by day to be named in said order
and notice and answer said petition and prove their respective claims to
said surplus; and at any time after the day upon which appearance and
answer is required to be made as aforesaid, said petitioner or any person
who may have appeared and answered said petition may upon proper
application to said court ask to have said proceedings referred to the Audi-
tor of the Court with directions to take such testimony as may be pro-
duced to him by any of the parties interested, touching the matter of said
petition and from said testimony and proceedings to state an account dis-
tributing said surplus which said account the said auditor shall with the
testimony taken by him return to the court on or before a day to be named
by said court and thereupon the said court shall set down said petition
and proceedings thereunder for final hearing, and it shall then be deter-
mined by said court as to what persons are entitled to receive said surplus,
and when so decided said court shall pass an order directing said sheriff
or ex-sheriff as the case may be to pay over said surplus in accordance
with the decision and finding of said court, and said sheriff or ex-sheriff
shall not be held liable in any respect for so doing, and there shall be no
appeal from the decision of said court in the premises.

453. The State's Attorney of Cecil County shall receive an annual
salary of two thousand dollars to be paid to him by the County Commis-
sioners of said county in monthly instalments, the same to be levied by
the County Commissioners for the use of the State's Attorney as aforesaid.

454. Said amount shall be in lieu of all trial fees, except in such special
cases as in the judgment of the County Commissioners may require addi-
tional compensation, when the Commissioners may allow the State's Attor-
ney such additional sum as in their judgment may seem right and proper.

455. The Supervisor of Assessments of Cecil County is authorized to
appoint a clerk and the salary of said clerk shall be fifty dollars a month
to be paid by the County Commissioners of Cecil County monthly.*
