2030 ARTICLE 8.

plied to the use of the town, as may from time to time be directed by the
President and Commissioners; and all such fines, penalties and forfeitures
may be recovered before a justice of the peace by warrant, judgment and
commitment to the town hall in the same manner that commitments are
made for fines imposed by the circuit courts of this State; provided, that
no commitment under this section shall be for a longer period than two
days, nor until after hearing and judgment; but the President and Com-
missioners shall have power at any time to remit or release the said fines,
penalties, forfeitures and costs, or any part thereof, at their discretion;
but any party who shall be fined, or subjected to any penalty or forfeitures,
within five days after the same shall be imposed and judgment recov-
ered, may supersede or stay the same for thirty days, by giving security
satisfactory to the said justice of the peace; and the said fines, penalties
and forfeitures shall thereafter be collected as small debts are now col-
lectible before a justice of the peace.

RAILROADS.

379. The Philadelphia, Wilmington and Baltimore Railroad Com-
pany, and the Philadelphia branch of the Baltimore and Ohio Railroad
Company, shall respectively station a guard of at least one person at the
following crossings, that is to say: where the Philadelphia, Wilmington and
Baltimore Railroad crosses the county road near what is .known as "Red
Mill," near Elkton; the foundry crossing in Perryville; the Philadelphia
branch of the Baltimore and Ohio Railroad, where said road crosses the
county road which leads from North-East to Bayview; and also at such
other crossings of public roads, streets, avenues and turnpikes as may
from time to time be designated by order of the County Commissioners,
as the public necessities may in the future from time to time require, which
said order shall not be passed until after thirty days' notice has been given
to the company, and an opportunity hs.s been given to be heard as to such
supposed necessity; and at all such points where the track of any other
railroad company now existing or hereafter to be created, using steam
engines, crosses or intersects any turnpike, public road, street or highways
as may be so designated by such County Commissioners, it shall be the
duty of the railroad company or corporation owning or using said track
to station a guard of at least one person; and it shall be the duty of such
guards to warn all persons who may be lawfully upon such street, ave-
nue, turnpike, public road or other highway, of the approach of all loco-
motives or trains of cars, by displaying in as conspicuous a manner as
possible, a flag by daylight and a colored light during the hours of dark-
ness, or to close safety gates on the approach and passage of trains or loco-
motives, either or both, as the County Commissioners may deem necessary,
and to continue such duty from seven o'clock A. M. until nine o'clock
P. M. each day.
