one hundred dollars of assessable property on or before the first day of
December, in each and every year.

209. The President and Commissioners of the town of Elkton, in addi-
tion to the powers already possessed by them, and with the sanction and
consent of said Auxiliary Board shall have the right and power to acquire
by purchase or condemnation any land, improvements, rights of way, wa-
ters, water courses or other property of any kind whatsoever, whether used"
for private purposes or already devoted to a public use, or any interest
therein, or any franchise connected therewith, for the purpose of estab-
lishing a water system, or water plant, for the town of Elkton. In all con-
demnation cases instituted for any of the purposes above mentioned, the
procedure followed may be that, now or hereafter prescribed or authorized.
by its charter, in a particular case, or it may in any case, in its discretion,
adopt and pursue the method provided and prescribed by Article 33A of
the Code of Public General Laws of this State, and after the said new
system of water works shall be established for said town, the President
and Commissioners of said town of Elkton are hereby fully authorized by~
ordinance to provide for the operation and management of said water sys-
tem, and to regulate the charges to be made for furnishing water to per-
sons, firms and corporations using the same.*

209A. Should the voters at said election declare in favor of issuing
said water bonds, then the said President and Commissioners of the town
of Elkton shall at once proceed either to erect a water plant for said town
or to purchase the property, plant, rights and franchises of the Maryland
Water Company of Cecil County, at a price to be agreed upon, and, if the
purchase price cannot be agreed upon., then they shall, in case they shall
decide to acquire the plant of the Maryland Water Company, instead of
building a new one, at once proceed to condemn the same in the manner
as provided by the Code of Public General Laws of the State of Maryland,
Article twenty-three, title "Corporations," and all rights, powers and priv--
ileges conferred by said Article upon the corporation herein mentioned
relating to the condemnation of land is hereby expressly conferred upon
and vested in the President and Commissioners of the town of Elkton for
the purpose of acquiring the property, real and personal, and the rights
and franchises of the Maryland Water Company of Cecil County, and for
any other necessary purpose of establishing, owning and operating a com-
plete water supply system for the town of Elkton and the inhabitants
thereof; and after the acquisition of the property, rights and franchises
