P. L. L., 1888, Art. 8, sec. 86. 1876, ch. 140.

90. If any of said Commissioners, after they are elected, shall refuse to
qualify, or after they have qualified shall die, resign, remove from town,
or be otherwise disqualified, an election to fill said vacancy shall be held
after two weeks' previous public notice, to be put up as aforesaid by said
President and Commissioners, by hand-bills, and posted at the postoffice,
and three other public places in the town; provided, that no election to fill
vacancies shall be held so long as three of the Commissioners shall remain
who have been duly elected and qualified; and the said remaining Com-
missioners, not less than three, shall have all the powers conferred upon
said President and Commissioners as fully, to all intents and purposes, as
if the whole five were in office, duly qualified.

91. All such elections shall be held and conducted as shall from time to
time be directed by the by-laws of the corporation not inconsistent with
the provisions of this sub-title of this Article. If the inhabitants of the
town shall at any time neglect to make an election at the time herein men-
tioned, the power of electing Commissioners shall not cease, but the right
and power of said inhabitants in that respect shall continue, and the Presi-
dent and Commissioners for the time being shall continue in office until
such election shall be held.

92. The plat of the town on file and of record in the office of the Clerk
of the Circuit Court for Cecil County shall be deemed and taken as evi-
dence of its limits and boundaries.

93. The said board shall annually appoint by ballot a treasurer, who
shall be selected from among the members of said board, whose duties it
shall be to receive and receipt for all moneys belonging to said corpora-
tion or to which it shall be in any wise entitled, to collect and receive
all taxes, general or special, levied upon the assessed value of all prop-
erty within said town, and to receive the fines and penalties imposed by
said board and to discharge such other duties pertaining to his office as
are, or may be imposed by law or any ordinance of the said board; pro-
vided, that before entering upon the duties of said office the said treasurer
shall annually give bond to the said President and Commissioners, with
surety or sureties, to be approved by said board, in double the amount
of money, which said board shall estimate will come into the hands of
said treasurer during the term for which he shall be appointed, condi-
tioned for the faithful discharge of his duties as said treasurer, and the
said board shall have authority at any time to require the said treasurer
to give additional bond or security conditioned as aforesaid, for the amount
of money in his hands or to come into his hands during his term of office
shall be greater than is estimated as aforesaid by said board. Said treas-
