incorporated town in Cecil County, or within the circuit of one mile of
any such incorporated town, unless he shall first pay to the Clerk of the
Circuit Court for said county the sum of seventy-five dollars for such
privilege for one year; or eight dollars per day for each day he may be
employed in selling as aforesaid, to be applied to the use of the State
and paid into the treasury thereof by said clerk.

38. The provisions of the preceding section shall apply only to such
persons as shall bring goods, wares or merchandise into the county to
sell at auction within the limits aforesaid, and to such persons as shall
sell at auction, goods, wares or merchandise sent into the county, and the
limits aforesaid, for the express purpose of being sold upon commission.

39. Any person who shall so sell within the said limits, without having
previously paid the license herein directed, shall be liable to a penalty
of one hundred dollars for each offense, to be recovered by the State in
the same manner as debts of like amount are recoverable.

40. The Clerk of the Circuit Court shall be entitled to the same fees
and commissions for issuing the license, and paying into the treasury the
money therefor, as for like licenses under the laws of this State.

41. No person shall be entitled to engage in business as an auctioneer
in Cecil County unless he shall have first taken out a license as herein-
after provided.

42. It shall be the duty of the Clerk of the Circuit Court of said county
to issue auctioneer licenses to such persons as may apply for and be enti-
tled to them under this Act, and according to the conditions and provi-
sions of this Act, the amount so received from said license to be paid to
the School Commissioners of Cecil County to be credited by them to the
school fund of said county.

43. Each applicant for such a license shall pay the yearly sum of five
dollars ($5.00) if he be a resident of said county; the sum of fifteen
dollars ($15.00) if he be a resident of the State outside of said county;
and the sum of twenty-five dollars ($25.00) if he be not a resident of
the State, and no license shall be issued by said Clerk of the County Court
to any such person until the aforesaid license fee has been paid and until
such person has made oath as to his place of residence.
