year from the first Monday in June next after his election and until his
successor is elected and qualified. Should the Mayor or any of the Coun-
cil, or any other officer of said town be continuously absent from said
town for a period of sixty days or absent from three consecutive meetings
which he is required to attend under the charter and ordinances of Mid-
land then the office held by such official shall upon motion duly made and
seconded be declared vacant, and a notice of this action shall thereupon
be sent by the Clerk by registered mail to such official and the Council
and Mayor or acting Mayor shall thereupon make such appointments as
the majority of them shall decide to fill such vacancy until the next
general town election.

Should the Mayor be absent for a shorter period than sixty days, then
and in such case the Clerk shall act as Mayor during the absence of that
official.

By and with the consent of the Council, the Mayor shall appoint and
employ all agents, servants and employees not otherwise provided for by
law, who may be required for the purpose of said corporation, annually;
and shall, by and with the consent of the Council, fix the compensation for
said officers. He shall have the power to remove any officers so appointed
by him, for cause; he shall have general supervision of the town, to pre-
side at all sessions of the Council and have a casting vote; see that the
ordinances are enforced, and from time to time report to the Council such
matters as in his judgment require their attention; he shall have power
to administer oaths and to certify the same in all matters pertaining to
said corporation, and for the purpose of hearing and determining all cases
to which the corporation may be a party, he is hereby clothed with all the
powers of a justice of the peace, except as to civil cases; he may pass sen-
tence and impose fines for all violations of the ordinances of said corpora-
tion, or may imprison, or may both fine and imprison offenders against
said ordinances, and to carry out his said powers he is hereby vested with
the authority to issue subpoenas for witnesses, and compel their attend-
ance by fine for contempt, and shall have the power to include in his fines
for the violation of ordinances, the usual costs, which are allowed to the
justice of the peace and to witnesses and to the bailiff for serving the
process, such as are allowed constables, under the laws of this State;
provided that no ordinance shall be passed imposing a fine of less than
one dollar nor more than 75 dollars, nor for a term of imprisonment ex-
ceeding thirty days; and provided, also, that all fines imposed and col-
lected shall be paid into treasury of the town. No order or resolution
for the payment of money out of the town treasury shall be valid without
his approval in writing. During his term he shall hold no other corpora-
tion office, nor shall he be interested in any contract in which the cor-
poration is a party; he shall receive the sum of twenty-five dollars per
year for his official services, payable annually. Before entering upon
the duties he shall take and subscribe before the retiring Mayor or any
justice of the peace in Allegany County, the oath prescribed in Section 6
