in accordance with the rules and regulations of the Board of Trustees
of the Maryland State College of Agriculture; provided, however, that
if no representative of the manufacturer or manipulator, or said Agent
be present, at the time of said sampling, then two disinterested wit-
nesses, and not one as above provided, must be present that samples so
taken shall be from unbroken bags, or packages, which have not been
damaged or injured in transit, or by exposure, and which have not been
in possession of the owner more than thirty (30) days, provided, fur-
ther, that said samples be taken from at least 5% of the bags or pack
ages comprising the brand purchased and if there are less than 100
bags, or packages, of the brand so purchased samples shall be taken
from not less than 5 bags or packages, and if there are less than 5 bags
or packages samples shall be taken from each. All such samples shall
be taken under such additional rules and regulations as may be pre-
scribed by the Maryland State College of Agriculture, provided fur-
ther, that every sample sent for analysis to the said College shall be
fully described on forms to be furnished by said College free of charge,
said description giving a full and complete statement of the time and
place of sampling, of all marks on the bags or packages thereof, and of
all the facts relating to the same, said description and statement shall
be signed by the purchaser of the fertilizer, the person drawing the
sample and the disinterested witness or witnesses as above provided;
and provided, further, that the purchaser, or purchasers, sending such
sample, or samples, of fertilizer to said College for analysis shall with-
hold said description or descriptions, of said sample, or samples, until
he has received from the said Maryland State College of Agriculture
the report of the analysis of said fertilizer. Any person, or persons,
receiving an anlysis from the said College as required under this Arti-
cle shall immediately thereafter forward to it the statement required by
this Article to be made at the time of taking the sample or samples.

10. It shall be the duty of the Maryland State College of Agricul-
ture to analyze upon request, without cost or charge, all samples of fer-
tilizer sent to said College and taken in the manner prescribed in this
Article. The said College, the State Chemist, or his assistants or agents,
shall not demand of any purchaser so sending sample, or samples, for
analysis any advice, information, or statement, as to any analysis
appearing on the original unbroken packages, or bags, from which said
sample or samples were taken, or the name or names of any individual,
representative, agent, or corporation or firm from which said fertilizer,
or fertilizers, were purchased; and it shall be the duty of the said Col-
lege, through its duly authorized agent, the State Chemist, to at once
make a full and complete analysis of the sample, or samples, received in
accordance with this provision and within thirty (30) days thereafter
return to such person, or persons, from whom the sample, or samples,
were received a full and complete analysis of said sample or samples.
