bartered by him, he shall on conviction pay a fine of not less than
fifty nor more than two hundred dollars, together with the costs of
prosecution, and upon failure to pay the same shall be committed to
jail and confined therein until such fine or costs are paid, or for the
period of forty days, whichever shall first occur; and it shall be the
duty of the court before whom said person shall be convicted to sup-
press the license.

97. If any person shall take out an ordinary license as herein pro-
vided without having the bedding and other accommodations required,

98. It shall not be lawful for any person, or for any club or associa-
tion, or for any corporation now formed or hereafter to be formed, or
for any officer, agent or employe of any such club, association or corpo-
ration, to hire or employ any minor to sell or dispense anywhere in
the State any beer or spirituous or fermented liquors of any kind at
retail, where such beer or liquors are to be drunk upon the premises.
Any person violating any provision of this section shall upon convic-
tion be fined a sum not exceeding one hundred dollars.

99. The clerk shall not, without the special order of the court or-
the judge thereof, grant a license to any person to sell spirituous or
fermented liquors from whom the grand jury has recommended a
license to be withheld or to a person whose license has been suppressed
by the court.

This section is a valid regulation under the police power. Cahen v. Jarrett,

100. In all prosecutions for a violation of any of the provisions of
this article relating to license to sell goods, wares, or merchandise, or
spirituous or fermented liquors, one-half of the fine shall be paid
to the informer and the other half to the State; and it shall be the duty
of the grand jury to endorse on the back of the indictment the name
of the informer.
