92 LAWS OF MARYLAND. [Ch. 39]

CHAPTER 39.

AN ACT to authorize and empower the Mayor and Aldermen of
Frederick to issue and sell bonds for a sum of money not
exceeding sixty thousand dollars ($60,000.00), for the pur-
pose of increasing the water supply and facilitating the dis-
tribution thereof in the corporation of Frederick by the
erection of a storage reservoir, or lake, on Tuscarora Creek,
or Fishing Creek, in Frederick county, Maryland, and for
the purpose of acquiring title by purchase or condemnation
of such land, on the watershed of either or both of said
streams, as the Mayor and Aldermen of Frederick shall think
proper, and to provide for the levy and collection of all taxes
necessary for the payment of the interest on said bonds and
for the creation of a sinking fund out of the funds derived
from water rents, for their payment upon maturity.

WHEREAS, For a number of years the sources from which the
corporation of Frederick obtains its water supply, have been,
and still are, inadequate, during the summer and fall to fur-
nish sufficient quantities to meet the demands of the city,
while in the winter and spring large quantities of water run
to waste, which if properly conserved by the building of a
storage reservoir, would be sufficient to meet the demands of
the city for years to come; and,

WHEREAS, The Mayor and Aldermen of Frederick have been
advised by a number of reputable hydraulic engineers that
the building of a storage reservoir, or lake, is imperative for
the present and future needs of the city; and,

WHEREAS, On account of the increased water pressure, result-
ing from the recent improvements, a much greater quantity
will be consumed in the future than has been used hereto-
fore; and,

WHEREAS, In the summer and early fall, when the stream
flows in the creeks, which furnish the city with water, is at
its lowest, the consumption in the city is at its maximum;
necessitating on a number of occasions the installation of a
pumping station for the purpose of obtaining an additional
quantity of water, an expensive process, which would be
