PHILLIPS LEE GOLDSBOROUGH, ESQ., GOVERNOR. 863

SEC. 4. And be it enacted, That the power to issue the
bonds herein granted is conditional, and it is hereby provided
that the question of issuing said bonds, the amount of the issue
and the specific purposes to which the proceeds are to be applied,
shall be submitted to the qualified voters of the town at an
election to be held therein, for which said election the Mayor
and Council shall provide by ordinance. If the majority of
the votes cast at such election be in favor of the issue of said
bonds, the Mayor and Council may proceed to issue said bonds,
but if a majority of the votes cast be against the issue of said
bonds they shall not be issued.

SEC. 5. And be it enacted, That this act shall take effect
from the date of its passage.

CHAPTER 591.

AN ACT appropriating the sum of money therein mentioned to
refund to the Board of County School Commissioners of
Talbot county, being certain moneys which should have been
paid to the Board of County School Commissioners of Talbot
county and which were erroneously paid to the Comptroller
of the Treasury of the State of Maryland by the clerks of the
Circuit Court for Talbot County, on account of fees collected
by the clerks of the Circuit Court for Talbot County on
account of tongers' licenses issued by them in the years 1894-
1895 to 1909-1910.

WHEREAS, In accordance with the opinion of the Circuit Court
for Talbot County in the cause of the Board of County School
Commissioners of Talbot county vs. Francis G. Wrightson,
clerk of the Circuit Court for Talbot County, construing the
Public Local Law, enacted in Chapter 314, section 3, Acts
of 1894; the Public General Law, enacted in Chapter 380,
section 2, Acts of 1894; the Public Local Law, enacted in
Chapter 165, Acts of 1906; and the Public General Law,
enacted in Chapter 434, section 2, Acts of 1910. It appears
that the clerks of the. Circuit Court for Talbot County have
paid in the years 1894-1895 to 1909-1910 certain moneys
which amounts have been certified to by the Comptroller of
