vided, that in all cases where highways, roads, streets or other
public properties are to be used, permission be first obtained
from the County Commissioners or Town Commissioners, as
the case may be. Provided also that said corporation before
commencing work or construction upon any portion of any State
road or roads included in the State Roads System, constructed
or adopted as'a part of the State Roads System, shall apply
to the State Roads Commission for a permit to construct its
lines and overhead equipments upon or over any such road, and
all work done under such permit upon any such road or cross-
ing of said road, shall be done in conformity with the rules
and regulations of the State Roads Commission, and located
and designated by said commission, and in full compliance
with the provisions and terms of any permit granted by said
State Roads Commission and to the satisfaction of said com-
mission; and before doing any such work the said corporation
shall file with the State Roads Commission, if required, a bond
in such amount and penalty as the State Roads Commission
may require for the satisfactory performance of all terms, con-
ditions of said permit.
SEC. 8. And be it enacted, That said corporation, within
the scope of all the purposes hereinbefore mentioned, shall have
and enjoy besides those powers and privileges in this act
particularly enumerated, all other general powers, provisions
and privileges conferred by the general incorporation laws of
this State upon companies duly incorporated under the same,
and shall be subject to the general regulations in such law,
except in so far as altered by the provisions of this act; pro-
vided, that nothing in this act shall be construed to authorize
the company to acquire any property by condemnation except
that which shall be necessary for the construction, mainten-
ance or operation of the railroad; for every other purpose the
said acquisition shall be by purchase.
SEC. 9. And be it enacted, That for the term of five years
after the commencement or transportation of freight or passen-
gers for hire the tolls and income shall be subject to State taxa-
tion only; and after said term of five years the same shall be
subject to taxation for State and county and municipal pur-
poses.
SEC. 10. And be it enacted, That nothing in the provisions
of this act shall exempt this corporation from the provisions of
Chapter 180 of the Acts of 1910, known as the Public Utili-
ties Law.
