SEC. 43. The Mayor and Common Council shall not expend
or contract to expend in any one fiscal year more money than
the amount receivable from taxes and other sources during that
year, except from special assessments as herein provided. The
Mayor and Common Council may also from time to time bor-
row money for the use of the town and issue therefor the bonds,
notes or other obligations of the town, to an amount not exceed-
ing as the principal the sum of five thousand dollars of outstand-
ing indebtedness at any one time, the same to bear such rate
of interest and to be payable or renewable in such manner as
said Mayor and Common Council may agree; provided fur-
ther, however, that said Mayor and Common Council shall not
have power to issue any obligations in the name of the town
which are payable more .than twenty years after date of their
issue. Provided, however, that no such moneys shall be so bor-
rowed, on either bonds, notes or other obligations, unless the
issue of said bonds, notes or other obligation shall first have
been submitted to a vote of the registered voters of the town,
and shall have received the favorable vote of a majority of the
votes cast, and such question may be so submitted to the voters
either at any regular election or at any special election called
for that purpose by the Mayor and Common Council in accord-
ance with the provisions herein provided for the holding of
other elections. Provided further, that the Mayor and Common
Council shall be authorized and required to create and maintain
a sinking fund for the repayment of any loans so made to the
town.
SEC. 44. All streets, avenues, roads, bridges and public
alleys in the corporate limits of said town of Capitol Heights
are hereby declared to be under the supervision and control of
said Mayor and Common Council.
SEC. 45. For neglect of duty or incompetency any town
agent or official appointed by the Mayor or by the Mayor and
Common Council may be removed from office at any time by a
majority vote of the Common Council and the Mayor, the
Mayor's vote to be equal to that of any one of the members of
the Common Council for this purpose.
SEC. 46. In all cases where any municipal work of what-
soever character is to be done within the corporate limits of
Capitol Heights, the estimated cost of which shall exceed' the
sum of two hundred dollars, the Mayor and Common Council
shall invite proposals for said work by advertisement published
at least once a week for two successive weeks at least two weeks
prior to the date when proposals are to be submitted, in some
