ferent from that in which they are to appear on the ballot and
with said statement to mail also to each voter a detailed state-
ment from the Mayor and the Common Council of the financial
condition of said town, and all receipts and disbursements of
the town during the preceding year, and it shall further be the
duty of the Mayor and Common Council annually to prepare
such statements for distribution by said clerk.
SEC. 8. All elections hereunder shall be held within the
town limits at such place as the Mayor and Common Council
of Capitol Heights shall designate, after at least ten days'
public notice of the same given by them and said elections
shall be conducted by the judges of election and two clerks
thereof appointed by said Mayor and Common Council as
hereinbefore provided. Said elections shall be held from two
o'clock P. M. to seven o'clock P. M., when the polls shall be
closed and the ballots publicly counted, and the said judges
shall within two days after each election make a true and
correct return of the same under their hands to be addressed
and transmitted to the Mayor and Common Council.
SEC. 9. At a meeting of the said Mayor and Common
Council held on the second day after the election the returns
shall be opened by the presiding officer, and certificates of
election shall forthwith be issued by the clerk to the persons
appearing to be elected as mayor and treasurer, respectively,
and to each person appearing to be elected as councilman by
having received the highest number of votes, and the said
certificates shall be recorded among the proceedings.
SEC. 10. If at any election it shall appear from the returns
of the Judges of Election, that any two or more persons voted
for as Mayor, Treasurer or Common Councilmen have received
the same number of votes, so that there is no choice for the
office, a new election shall be immediately proclaimed by the
Mayor and Common Council to fill the vacancy, from among
such tie candidates, which election shall be held on ten days'
notice and in all respects as aforesaid, except as to day of
election and convening of the Mayor and Council.
SEC. 11. In case of failure to elect a Mayor and at least
three councilmen, those in office shall continue to perform the
duties pending an election which shall be held in the manner
and upon the notice prescribed in section 8. Every Judge
of Registration and Election before he proceeds to take regis-
tration of voters and thereafter to take or receive any votes
shall take an oath that he will permit every duly qualified
person to register and every duly registered person and none
