PHILLIPS LEE GOLDSBOROUGH, ESQ., GOVERNOR. 741

J. Shockley, and their successors as hereinafter provided for,
be and they are hereby named and designated as trustees, with
power and authority to receive and accept such private subscrip-
tions as may be offered them from time to time by owners of
property rights adjacent to and bordering on said Pocomoke
River; provided the same when offered and paid at any one
time shall be at least the sum of one hundred dollars; and upon
the payment of such subscription of not less than one hundred
dollars to said trustees, or their successors, the said trustees and
their successors are hereby directed to forthwith deposit the
same in the First National Bank of Snow Hill, Maryland, and
the commissioners holding the funds provided for by said
Chapter 215 of the Acts of the General Assembly of Maryland,
passed at the December Session, 1940, and the amendments
thereto, are likewise directed to deposit in said First National
Bank of Snow Hill a sum equal to the amount so paid to said
trustees or their successors by private subscription aforesaid
and so deposited by said trustees; all said funds so deposited,
both by said commissioners and by said trustees, to be to the
joint credit of said commissioners and trustees, and the aggre-
gate sum so obtained shall be forthwith expended under the
joint direction of said trustees and commissioners and their
successors in the cleaning out of said river aforesaid, in such
manner as to the said trustees and commissioners and their suc-
cessors shall seem to the best public interest; the powers and
duties hereby conferred and imposed upon said trustees and
their successors and said commissioners and their successors, to
be cumulative and continuous until the fund in the hands of
said commissioners and their successors shall be exhausted.

SEC. 2. And be it further enacted, That in the event of any
vacancy in the said trustees by death, resignation or otherwise,
the remaining trustee or trustees shall fill such vacancy or
vacancies by appointment in writing, and in the event of fail-
ure of said remaining trustee or trustees to make such appoint-
ment within thirty days after such vacancy or vacancies shall
occur, or in the event of the refusal of all of said trustees or
their successors to serve, then upon the application of any
person owning property rights adjacent to or bordering on said
river south of Whiton aforesaid, the County Commissioners of
Worcester County shall appoint a trustee or trustees to carry
out the trusts created by this act, so as to maintain at all times
a board of three trustees for the purposes of this act, until the
fund in the hands of the commissioners aforesaid or their suc-
cessors shall be exhausted.
