hearing shall be entitled to an appeal from the decision of the
said County Commissioners to the Circuit Court for Dor-
chester County; provided, that said appeal is taken within five
days thereafter, which appeal shall be heard de nova by said
Court in special session, or at its next regular term, without
the intervention of a jury; and if the said Court, after hear-
ing all the evidence, shall find that the said County Road Engi-
neer is incompetent or has been guilty of wilful neglect of
duty, it may pass an order removing said County Road Engi-
neer from office, in which case the said County Road Engineer
shall not be entitled to receive any salary from the date of the
order of the County Commissioners, from which such appeal
was taken.
SEC. 271. The County Road Engineer shall reside in Dor-
chester county during the term of his office, and shall have
charge, control and supervision of the working, repairing and
construction of the public roads and bridges in said county, and
shall make all the specifications for the building of new roads
and bridges, and shall see that no obstruction, hindrance or
injury is or shall be permitted upon any road or bridge under
his supervision. He shall have charge and control of all teams,
carts, wagons, machinery, implements and accessories which
may be purchased or provided by the County Commissioners
for the purpose of this act; and shall employ such labor, teams
and implements as may be by him and the County Commis-
sioners deemed necessary in connection with work on public
roads and bridges to be paid for by the County Commissioners.
He shall not work out or expend upon the roads and bridges of
said county a greater amount in any one fiscal year than the
amount levied by the County Commissioners for this purpose,
without obtaining the written permission of said County Com-
missioners. He shall appear before the Commissioners at the
first meeting in each and every month, and make a statement
to them of the work done and money expended. He shall
examine and certify to the correctness of all bills and accounts
for any work done or materials furnished for any of the public
roads or bridges in Dorchester county before the same shall be
paid by the County Commissioners; and the said County Com-
missioners shall make no payment until such accounts have
been certified: by said engineer. He shall make out annually,
in writing, a detailed report of all work done on the county
roads and bridges for the year, together with the names of all
persons working on said roads and bridges, and the amount to
which each person is entitled for such, work, and which he has
certified as correct, which report shall be made on or before the
