as said sections 55 and 55A were amended and enacted, respec-
tively, by the General Assembly of 1902, Chapters 288 and
17, respectively, be and the same are hereby repealed and
re-enacted with amendments; and that a new section be and
the same is hereby added thereto to follow immediately after
section 57 and to be known as section 57A, so that all of said
sections shall read as follows:

SEC. 53. It shall not be lawful to kill in Montgomery
county any robin, bluebird, thrush, martin, mocking bird, barn
swallow, mason swallow, lark, oriole, redbird, catbird, chipping
or summer sparrow; wren, pewit, goldfinch, sapsucker, hanging
bird, woodpecker, fly catcher and tanager; and it shall not be
lawful for any person to unnecessarily destroy the nests or take
the eggs or the young of any of the birds protected by this sec-
tion; provided, however, that nothing in this section shall be
construed as to prevent the killing of or capture of crows,
hawks, owls or other kinds of birds of prey. Any person violat-
ing any of the provisions of this section on conviction thereof
shall be fined not more than five dollars for each and every
offense, to be recovered in the name of the State before a
justice of the peace, said fine to be applied to the county school
fund.

SEC. 54. No person shall hunt, trap, shoot or in any man-
ner catch, kill or take or have in his possession in Montgomery
county any partridge or quail between the twentieth day of
December and the tenth day of November, nor any woodcock
between the first day of January and the first day of July, nor
any pheasant between the first day of January and the first
day of September, nor any wild turkey between the first day
of March and the first day of November, nor any gray squirrel
between the fifteenth day of December and the fifteenth day
of August, nor any rabbit between the twentieth day of Decem-
ber and the tenth day of November, nor any raccoon, nor any
opossum between the fifteenth day of January and the fifteenth
day of October, nor any muskrat between the first day of
March and the fifteenth day of November of each and every
year; and it shall not be lawful for any person in said county at
any time to trap, net or ensnare any of the animals, birds or
fowls enumerated in this section, or to set any trap, net or
snare in or about any fox den, or to have in his possession any
trap, net or snare with the intent or purpose to capture or kill
any such animals, birds or fowls, and it shall also be unlawful
for any person to track when the snow is on the ground any of
the animals, birds or fowls enumerated in this section for the
purpose to capture or kill such animals, birds or fowls, and any
