ness; and in each action taken the aye or nay vote of each
councilman shall be recorded opposite his name. Any action
taken by less than a two-thirds vote of all the councilmen
require the approval of the Mayor in order to be effective.
The Council shall pass rules consistent with the provisions of
this act for their own government while in session. A council-
mans absence from three consecutive meetings without exuse
shall constitute a vacancy. All vacancies occurring six months
or more before the regular annual election shall be filled by a
special election called by the remaining members by giving ten
days' notice; all vacancies occurring less than six months before
the regular annual election shall be filled by the remaining
members of the Council by appointment from the ward in
which the vacancy occurs. The Mayor shall preside at meet-
ing of the Council, and shall call such meetings from time
to time as he may deem necessary, but in no case of his absence
from any meeting the councilmen present shall elect one of
their number to preside who shall have for the time all the
authority of Mayor.
SEC. 7. Annually on or before the first Monday in April
the Council shall appoint three judges who shall appoint a clerk
and conduct an election by ballot on the first Monday in May,
for the election of officers specified in section 5 of this act,
the polls to be opened at one o'clock P. M. and closed at six'
o'clock P. M. The judges and clerk shall receive no compensa-
tion for their services, not more than two of the judges shall
be of the same political party. The Council shall receive all
returns of election and determine all questions arising there-
under. but any person interested may appeal therefrom to the
Circuit Court for the county who shall determine such appeal.
SEC. 8. The Mayor with the approval of the majority of
the Council shall appoint a marshal, a health, officer, a clerk
and a treasurer, to hold office for one year or until their
successors are appointed and qualified. The Council shall fix
the compensation of each and of all subordinates under them,
and shall prescribe their duties except as herein provided. The
marshal and the health officer shall each with the approval of
the Mayor appoint such assistant or assistants as the Council
may allow, and shall be held responsible under the Mayor
for the enforcement of such ordinances as the Council may pre-
scribe. They shall attend the meetings of the Council and
perform such duties as they may be directed. The clerk
shall keep the minutes of the proceedings of the Council in a
well-bound book to be provided by the Council, which shall be
open to inspection of all persons interested therein. He shall
