be the duty of the person impounding any such stock or geese,
or knowing the same to be running at large, to report the same
to a justice of the, peace, together with the name of the owner,
as soon as he discovers the same; and it shall be the duty of
such justice of the peace to forthwith issue a summons against
such owner in the name of the State, for the use of the person
informing to answer in a plea of trespass; and if it shall appear
upon testimony taken that such swine, goats, stock or geese
were found at large within the aforesaid village, the justice
shall render judgment against the owner for the sum of two
dollars, as herein prescribed, together with costs; provided, that
if the owner of such stock, goats, swine or geese shall make it
appear to the justice of the peace -that the same went at large
through no fault or negligence on the part of himself or agent,
and that he and his agent or servant used reasonable care to
prevent the same, then the said fine shall not be imposed, but
judgment shall be given for costs only.
SEC. 5. And be it enacted by the General Assembly of Mary-
land, That this act shall take effect from the date of the pas-
ge.

CHAPTER 358.
AN ACT to repeal and re-enact with amendments section 1 of
Chapter 179 of the Acts of 1908 of the General Assembly of
Maryland, entitled "An Act to regulate the sale and granting
of licenses for the sale of spirituous and fermented liquors in
Baltimore county."

CHAPTER 359.
AN ACT to authorize and empower the Association of the Mary-
land Line to surrender and transfer to the School Commis-
sioners of Baltimore County for the use and purpose of a
public school such portion, if any, of the land or buildings
of the property formerly known as the Pikesville Arsenal and
now known as the Confederated Soldiers' Home, as said asso-
ciation of the Maryland Line may be willing so to transfer, and
