struction and permanent maintenance of such public park or
parks.

61B. Any person who shall wilfully or maliciously injure,
disfigure or destroy any monument erected in any public park
or parks within the corporate limits of Ellicott City or take
and carry away any growing tree therefrom, or destroy any
vine, plant, shrubbery, root, vegetable, or fencing thereon shall
be deemed guilty of a misdemeanor, and after presentment and
indictment by the grand jury for Howard county, and convic-
tion thereof, in the Circuit Court for Howard County, shall,
in the discretion of said Court, be imprisoned in the Maryland
House of Correction for a period not exceeding three years, or
be fined not more than one thousand dollars ($1,000), or
be both fined and imprisoned as aforesaid.

SEC. 2. And be it enacted, That this act shall take effect
from the day of its passage.

CHAPTER 355.

AN ACT to repeal and re-enact with amendments section 158
of Article 23 of the Code of Public General Laws of the
State of Maryland, title "Corporations," sub-title "Insurance
Department."

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That section 158 of Article 23 of the Code of Public Gen-
eral Laws of the State of Maryland, title "Corporations," sub-
title "Insurance Department," be and the same is hereby
repealed and re-enacted, with amendments, so as to read as fol-
lows:

158. There shall be a distinct department, to be known as
the State Insurance Department, which shall be charged with
the execution of the laws of this State in relation to insurance,
the principal office for which shall be located in the City of
Baltimore. The chief officer of said department shall be
appointed by the Governor, Comptroller and Treasurer, or by
a majority of them, for the term of four years, and shall be
known as the State Insurance Commissioner of Maryland, who
shall receive an annual salary of twenty-five hundred dollars,
payable only out of the receipts of said department authorized
by this article; provided, however, that no person who is a
