1572 LAWS OF MARYLAND. [Ch. 809]

County," sub-title "Church Hill," as amended by the Acts of
1892, Chapter 652, and to add certain sections thereto to be
known as sections 113A and 113B.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That section 113 of Chapter 652 of the General Assembly
of 1892 is hereby repealed and re-enacted, and to add certain
sections thereto to be known as sections 113A and 113B, to
read as follows:

SEC. 113. Be it enacted, That the Commissioners of Church
Hill shall have full power and authority to grade, curb and
pave, or cause to be graded, curbed or paved, all sidewalks, gut-
ters and sewers which, in their judgment, the public conven-
ience may require, and from time to time, if necessary, to change
or alter the grade of any streets already graded, and to repave
or repair any sidewalks, gutters or sewers whenever and with
whatever kind of material they may require, and to collect the
expense of grading, curbing and paving or otherwise improving
the same, as directed in the next succeeding section.

SEC. 113A. And be it enacted, That whenever the person or
persons owning the property fronting on any such sidewalks
shall refuse to have such sidewalks, gutters and sewers paved
when directed to do so by any ordinance within thirty days from
the date of its passage, the said Commissioners of Church Hill
shall have the materials found and the work done, and shall
cause the clerk to the said Commissioners of Church Hill to
ascertain the proportion of expenses chargeable to each pro-
prietor or owner, and may recover the same by action in the
Circuit Court, or before the justice of the peace, according to
the amount awarded, or may distrain the personal property of
such proprietor or owner at any time within six months from
the time when the ascertainment of the proportion of such pro-
prietor or owner shall be made by the clerk to the said com-
missioners; provided, that ten days' notice shall be given by
the Commissioners of Church Hill to the said proprietor or
owner of the amount of his or her assessment prior to such suit
or distress.

SEC. 113B. And be it enacted, The Commissioners of
Church Hill are hereby empowered to pass all laws and ordi-
nances necessary for grading, curbing, paving, repairing and
regulating the sidewalks, streets, lanes, alleys, gutters and sew-
ers of said town, and impose a tax on any lot or lots fronting' on
any street, lanes or alley for the purpose of grading, regulating,
paving and repairing the sidewalks in front thereof or to compel
by fines or otherwise the owner or owners of any lot or lots to
