but in the event of the absence of the Mayor at any meeting
the members of the council present shall elect one of their own
members to preside during his absence, who shall, for the time
being, be clothed with all' the powers and authority of said
Mayor. A majority of the council shall constitute a quorum
for the transaction of business, and the council shall pass rules
and by-laws for their own government while in session.

486. Neglect or non-user shall not work a forfeiture of this
charter.

487. The council shall annually appoint a clerk, who shall
also be treasurer, who shall keep minutes of its proceedings in
a well bound book, which shall be open to the inspection of all
persons interested therein, and shall discharge such other duties
as the council may require; and said council shall also annually
appoint a bailiff and such under-bailiffs and other officers as
may be deemed necessary. They may also, if it is deemed
expedient, appoint a supervisor of streets.

488. .The council shall allow their clerk and supervisor, the
bailiff and other officers, such compensation for their services
as may be deemed reasonable.

489. The council and all other officers of the corporation
before they enter upon the duties of their respective offices,
shall take an oath that they will diligently and faithfully dis-
charge the duties of their office without favor, partiality or
prejudice.

490. The clerk and bailiff shall give bond to the Mayor and
council of Rockville in such penalty, and with such securities,
as may be required, conditioned for the faithful performance
of the duties of the office of clerk and bailiff, respectively; and
said bonds shall be recorded in the office of the clerk of the Cir-
cuit Court for Montgomery County.

491. The council shall receive all election returns and deter-
mine all questions arising thereon, and any person conceiving
himself aggrieved by reason of such decision, may appeal to
the Circuit Court for Montgomery County, which shall hear
and determine the same, and determine who shall pay the costs
of appeal. In case of a tie at any election for Mayor or mem-
bers of the council, another election shall be held after ten
