conspicuous places in the town, and publication at least twice
during that period in some newspaper of general circulation
in the town, that bid's will be received for said work. The
council may reject any dr all bids and advertise anew. When
such contract is awarded it shall be by ordinance duly passed.

236. Whenever it shall become necessary for any purpose
under this sub-title of this article to serve a notice or process
of any kind whatsoever upon any person or persons owning
property within the limits of said town, who may be absent
therefrom or now a resident thereof or upon whom, for any
other reason, personal service cannot be had, and the bailiff shall
make return to that effect, service of said notice or process may
be made by a publication of said notice or process once a week
for three consecutive weeks in some newspaper having general
circulation in said town, which said notice by publication shall
be as good and effectual as personal service. The affidavit of
the publisher or proprietor of said newspaper as to such pub-
lication shall be evidence of the fact thereof.

237. That the parts of the several county roads within the
limits of said town are hereby made and declared to be public
streets and avenues of said town, and shall be from time to
time improved and repaired as in the discretion of the council
the public interests may require and the resources of the town
will justify.

238. That the commissioners of Montgomery county, jus-
tices of the peace, sheriffs, constables and all other county and
State officers shall have, hold and exercise their offices and
jurisdiction in said town.

239. The town of Gaithersburg is hereby declared to bo
the legal successor of the commissioners of Gaithersburg, and
shall be entitled to and is hereby vested with all the property
and rights of every nature, whatsoever belonging to the com-
missioners of Gaithersburg; all proceedings now pending in
the name of the commissioners of Gaithersburg shall be con-
tinued in such name and remain unaffected by the adoption
of this charter. The Mayor and councilmen, and all other
officers of the town in office at the date of this act shall hold
their offices until their successors are elected or appointed and
qualified as herein provided, and all ordinances, regulations and
resolutions now in force and not inconsistent with the pro-
