before the day prescribed for his entering upon the duties of
his office, or before the annual levy of taxes is placed in his
hands for collection, as the case may be, or in the event of
the treasurer's removal from the county, death, resignation or
removal from office for misconduct therein, the county com-
missioners shall declare said office vacant, and at once proceed
to fill the same by appointment of a suitable person possess-
ing the qualifications herein prescribed, for the remainder
of the current term, who shall, within such time as the com-
missioners may direct, qualify and bond, as directed in the
.preceding section; and the County Commissioners are hereby
authorized to remove the treasurer for any misconduct or
neglect by him committed in the discharge of the duties of his
office.

131. He shall perform all the duties now by law required
to be performed by said clerk, or which may be required of
him by any future law or by any order of the County Com-
missioners.

132. He shall have the power, subject to the approval of
the county commissioners, to appoint such assistant or assist-
ants, at a compensation not. exceeding eighteen hundred dol-
lars in the aggregate, as he may deem necessary and proper
for the faithful and efficient performance of the work of his.
office, and the assistant or assistants so appointed shall take
the oath of office prescribed by the Constitution of this State,
and shall execute such bond or bonds as the said clerk may
require.

133. He shall have charge of all records, books and so
forth, belonging to the office of the county commissioners,
and shall not allow any of them to be removed or taken
from said office, except in obedience to a summons or order
of a court of law or equity of this State, and shall deliver
the same to his successor.

134. He shall collect all taxes levied by the county com-
missioners, and shall receive all moneys due to said county
from any source whatever, and shall disburse the same under
the provisions of law and the order of the county commission-
ers. It shall be his duly to promptly deposit all monies and
receipts by him collected in some bank, or banks, or banking
institution or institutions of Montgomery county, to be ap-
proved by the county commissioners, and it shall be obligatory
