said commissioners shall respectively serve. If, of the five
persons having the highest number of votes, two or more
shall be residents of the same collection district, the person
in said district having the highest number of votes shall be
declared elected, and the persons in the respective districts
having the highest number of votes shall constitute the board
of county commissioners.

328. They shall appoint a clerk, who shall be ex-officio
treasurer and collector of State and county taxes for said
county; and for his services as such he shall receive a salary
of two thousand dollars per annum; payable monthly, and no
other compensation or commission except the fees hereinafter
allowed in case of sales of personal property, and his duties
shall be as follows:

That before entering upon the discharge of the duties
of said office the treasurer of Montgomery county shall take
and subscribe before the clerk of the Circuit Court for said
county the oath prescribed in section 6 of Article
1
of the
Constitution of the State, and shall give a bond, to be exe-
cuted by himself and some surety or guarantee company incor-
porated under the laws of this State, to the State of Mary-
land,
in the penalty of an amount equal to the amount of
taxes to be placed in his hands for the next ensuing year, as
estimated by the county commissioners, with the condition pre-
scribed
in section
32
of
Article 81
of the Code of Public
General Laws of this State relating to the bonds of collectors
of State taxes, and also a bond to the State of Maryland, exe-
cuted
as
above provided,
in the penalty of $50,000,
condi-
tioned for the faithful performance of his duties as treasurer
of Montgomery county; said bonds shall be approved by the
county commissioners of said county, and new bonds shall be
given for each year that he shall hold office; provided, that
after the
first year of his
encumbency
said
bonds
may
be
executed and delivered at any time before the annual levy of
taxes is placed in his hands for collection, and all such bonds
shall
be
recorded
in
the office
of
the
clerk
of the Circuit
Court for Montgomery County, and the commissioners of said
county shall require
as surety upon such bonds
a surety or
guarantee company incorporated under the laws of this State,
and the said county commissioners shall levy such sums as
may be necessary to defray the expenses thereof.
