anything therein contained, he may plead the general issue,
and give the special matter in evidence for his defence, and if
verdict be given for him, or the plaintiff be non-suited or
discontinue, he shall recover treble costs; and if the plaintiff
be unable to satisfy them, the attorney who brought or prose-
cuted the suit shall pay them, unless the plaintiff shall give
security approved by the Court for such costs.

25. Each trustee of the almshouse of Montgomery county
shall be entitled to three dollars a day for each day he shall
attend to the duties of his office, and five cents for every mile
he shall necessarily travel from his place of residence to their
place of meeting, but no mileage in returning.

26. That the citizens of the Town of Barnesville, in Mont-
gomery county, be and they are hereby created a body cor-
porate by the name of "The Commissioners of Barnesville,"
with all the powers and privileges of a body politic and cor-
porate, and by said corporate name may have perpetual suc-
cession, sue and be sued, plead and be impleaded in Court of
law or equity, and may have and use a corporate seal.

27. That the corporate limits of the town shall be as fol-
lows : Commencing near a large oak tree standing on the east
side of the public road leading from Barnesville to Barnesville
Station, and running in a northeasterly direction with the
northern boundary of the property of John E. Knott to the
southeast corner of a lot owned by Dr. J. H. Stonestreet;
thence north following the eastern boundary of said Stone-
street's lot, the lot of the L. I. Hays estate and the lot of
Thomas Story to the main street of Barnesville; thence with
the south side of said street to a point opposite the eastern
line of the schoolhouse lot; thence crossing said main street
and following the eastern and northern line of said school-
house lot to the public road leading from Barnesville to Con-
ners; thence with eastern side of said road to northwest cor-
ner of Fred P. Hays' woods field; thence in a straight line
crossing said road, and through the lands of Hilton brothers
and others to the southeast corner of a field belonging to the
heirs of Major B. S. White; thence following line of said field
westerly to the mountain road; thence crossing said road and
through the lands of Mr. J. W. Brown in a straight line to
the northeast corner of B. F. Roberson's lot; thence following
northern lines of said Roberson's lot, the M. B. Church lot and
Maurice O'Neil's lot to northwest corner of said O'Neil's lot;
thence south to the public road leading to Dickerson; thence
crossing 'said road and running southwesterly to northwest
corner of Charles E. Darby's land; thence following north
