SEC. 2. Be it enacted, That any person or persons who may
violate the provisions of this act shall, upon conviction thereof
before any justice of the peace for said county, be fined for
each and every offence the sum of twenty-five dollars, and the
condemnation and forfeiture of nets, gill nets, float seins, weirs
and boats or canoes used in violation, as provided in section 1
of this act.
SEC. 3. Be it enacted, That any person or persons who may
be charged with violating the provisions of this act, upon con-
viction thereof upon trial before any justice of the peace in
said county, in addition to the fine imposed by the preceding
section, shall forfeit the nets, gill nets, float seins. boats or
canoes used in taking or catching fish as aforesaid, and upon
said conviction, the said justice of the peace shall order and
direct the constable or other officer making the arrest to sell
the said nets, gill nets, float seins, weirs, boats or canoes, after
giving at least ten days' notice by advertisement inserted in
some newspaper published in said county, or by advertisement
stuck, at three most public places, of the time and place of
sale; and the said sale shall be for cash; and after deducting all
costs and charges of advertising and making said sale, the bal-
ance of the proceeds of said sale shall be equally divided, and
one-half thereof shall be paid to the informer, and the other
half shall be paid over to the Treasurer of the School Board for
the use of the public schools of said county; provided nothing
in this act shall prevent the citizens of Wicomico and Somerset
counties from using the waters of Wicomico River in common
or the citizens of Wicomico and Dorchester counties from
using the waters of the Nanticoke River in common.
SEC. 4. " Be it enacted, That any person or persons feeling
aggrieved by any decision under the provisions of this act shall
have the right to appeal to the Circuit Court for said county.
SEC. 5. And be it enacted, That this act shall take effect
from the date of its passage.
