The new constitution was voted on at a special
election on September 18, 1867, and adopted by a
majority of over 24,000 votes. And the judges of
the Court of Appeals under the constitution of 1864
held their last session on November 12 following,
and then adjourned to November 26, 1867, at
which time, it was expected, the judges elected
under the new constitution would take their seats.
