SEC. 4. And be it enacted, That the Governor be,

which is authorised by the said acts, without injury to
|

the navigation of the Chesapeake and Ohio Canal,

|

agreeably to the provisions of the act of Congress, pas-
|
|

sed on the third day of March in the year eighteen
|
|
|
hundred and twenty-five, entitled, an act confirming
|
|
|
an act of the Legislature of Virginia, entitled, an act
|
|
|
incorporating the Chesapeake and Ohio Canal Com-
|
|
|
pany, and an act of the State of Maryland confirming
|
|
|
the same, and so soon as it shall be determined, in the
|
|
|
manner prescribed by the last mentioned act of Con-
|
|
|
gress, that the canal authorised to he made by this act
|
|
|
and by the original act, to which this is a supplement,
|
|
|
can be made without injury to the navigation of the
|
|
|
Chesapeake and Ohio Canal, commissioners shall be
|
|
|
appointed in the manner provided by the said original
|
|

SEC. 5. And be it enacted, That so much of the pro-
|
|
repealed
|
viso, in the fifth section of the aforesaid original act, as
|
|
|
requires that not more than one third part of the sums
|
|
|
subscribed for the capital stock of the said company
|
|
|
shall be demanded in any one year, shall be and the
|
|
|
same is hereby repealed.
