CHAP. 208.

CHAPTER 208.

Passed Mar.25, 1836

An act to lay out and open a road; in St. Mary's county.

Authority to appoint commis-

SECTION 1. Be it enacted by the General Assembly of

Maryland, That the Levy Court of St. Mary's county

 

are hereby authorised and required, if they shall deem

 

it necessary and proper so to do, to appoint three com -

missioners whose duty it shall be to survey, lay out

 

and open a read not exceeding thirty feet in width,

 

commencing at such point as the commissioners shall

 

determine upon, near the church on the public road

 

leading from the village of Chaptico to Darby's land-

 

ing to run from thence to and over the cause way, from

 

the old warehouse, to the wharf situated on the Chap-

 

tico run, so as to connect the said public road with

 

the said wharf by such route as will render the ap-

 

proach to said wharf most safe and convenient to the

 

neighboring people, for the purpose of shipping and

 

landing their goods and produce, and the said com-

missioners shall make out a plat of said road, and re-

 

turn the same to the Clerk of the Levy Court of said

county, to be recorded among the records of said levy

 

court, and the said road, when so opened, shall be

 

thereafter deemed to be a public road forever, and shall-

 

he kept in repair in said county.

Compensation — levy

SEC. 2. And be it enacted, That the expense of sur-

 

veying and opening said road shall he paid by the coun-

 

ty aforesaid, and the levy court of said county are

 

hereby authorised and required, on receiving from the

 

commissioners an account on oath of said expenses,

 

including an allowance of two dollars per day for each

 

commissioner, to levy the same on the assessable pro-

 

perty of said county.

Damages

SEC. 3. And be it enacted, That the commissioners,

 

or a majority of them, shall value and ascertain the

 

damages, if any, which the owner of the land through

 

which said road will pass, which damages, should any

 

be assessed, shall be levied and collected as other

 

county charges are, and paid over to the owner or to

 

the proper person.
