LAWS OF MARYLAND.

CHAP. 14.

necessary for the occasion; and thereupon the said

 

-commanding officer shall forthwith issue his order in

 

conformity with such requisition, under the penalty of

Penalty for ne-glect

five hundred dollars, to be recovered by indictment in

 

Baltimore city court, and such. further punishment as

 

may he provided by the brigade council; and any offi-

 

cer of the brigade who shall neglect or refuse to obey

 

the order of the commanding officer given as aforesaid,

 

shall forfeit the sum of two hundred dollars, to be re-

 

covered by indictment in Baltimore city court, and be

 

further punished in such manner as may be provided

 

by said council, and for neglect or refusal on the part

 

of any non-commissioned officer or private to obey the

 

order of his commanding officer, as above provided, he

 

shall forfeit the sum of fifty dollars, to be recovered by

 

indictment as above provided and be further punished

 

as said council may provide.

Of fines

SEC. 10. And be it enacted, That all fines incurred

 

under the laws made by the brigade council of the

 

Baltimore City Guards, shall be recoverable in the

 

name of the State, for the use of the said council, as

 

small debts are now recoverable, before a justice of the

 

peace, with the right of appeal as now provided by law.

Cavalry and artil-

SEC. 11. And be it enacted, That the aforesaid

council may, at any time hereafter, provide for the

 

raising and incorporating into the brigade aforesaid.

 

a company of cavalry and a company of artillery of

 

not more than one hundred members each, exclusive

 

of commissioned officers, and in such case said compa-

 

nies shall be entitled to representation in said council,

 

as provided for the other companies of the brigade by

 

the seventh section of this act.

Case of invasion

SEC. 12. And be it enacted, That whenever in case

 

of any foreign invasion, of the city of Baltimore, the

 

Baltimore City Guards shall be ordered into actual

 

aervice as part of the militia of this State, the same shall

form part of the third division of the Maryland Mili-

 

tia, and the officers of the brigade be entitled to rank

 

according to the date of their respective commissions,

 

with the officers of the regular line, and the brigade be

 

subject to the State militia laws during the time they
