SEC. 2. And be it enacted, That in any suit insti-

 

tuted under this act, the plaintiff or plaintiffs may de-

 

clare generally, and give the special matter in evi-

 

dence.

 

CHAPTER 138.

Passed Mar.16,1836

An act to authorise and empower Joseph L. Smith, of

 

Frederick county, tb convey to the proper owners, all

 

the lots in the town of Berlin, in said county, which

 

were sold by his grandfather Leonard Smith, and by

 

his father Joseph Smith, and not conveyed.

Preamble

WHEREAS, Leonard Smith, the grandfather as afore-

 

said, did, by his last will and testament, bearing date

 

the eighteenth day of March, seventeen hundred and

 

ninety-four, authorise and empower his son Joseph

 

Smith, to convey certain lots in the town of Berlin, as

 

aforesaid, which he the said Leonard Smith had sold,

 

also empowered him to convey all lots which he might

 

hereafter sell, — AND WHEREAS, the said Joseph Smith

 

failed to convey all the lots as aforesaid, in his life-

 

time, and did by his last will and testament, appoint

 

his son Joseph L. Smith, of Frederick county, his ex-

 

ecutor, but failed to authorise him to convey said lots :

 

Therefore,

Authority to convey

SECTION 1. Be it enacted by the General Assembly of

 

Maryland, That the said Joseph L. Smith, be, and he

 

is hereby clothed with full power and authority, by

 

deed of conveyance or otherwise, fully to convey to

 

each and every purchaser as aforesaid, of a lot or lots

 

in the town of Berlin, in Frederick county, such title

 

and estate, whether in fee-simple or otherwise, as the

 

said purchasers may respectively have contracted for

 

with Leonard Smith, the grandfather, or with Joseph

 

Smith, the father of the said Joseph L. Smith, provid-

 

ed, the said purchasers to, whom conveyances are made

 

under the aforegoing provisions, shall in every case,

 

have previously complied fully on their respective
