children of Alexander and Caroline Mundell as against

 

the executors and heirs at law of the said testator,

CHAP. 130

Preamble

John Hodges of Thomas, and Samuel Coe, the admin-

 

istrator of the said Alexander Mundell, and such pro-

 

ceedings were thereupon had by the said court, that on

 

the second day of December, in the year eighteen hun-

 

dred and thirty-five, it was adjudged, ordered and de-

 

creed by the said court, by and with the consent of all

 

the parties to the said bill, that upon the said Horatio

 

C. Scott bringing into the said court the sum of one

 

thousand dollars, with interest thereon from the fifth

 

day of March, in the year eighteen hundred and thirty-

 

two, the defendants, John Hodges and Rebecca Hodges,

 

therein mentioned, as the surviving executors of the"

 

late John Hodges of Thomas, and as the trustees there-

 

by appointed by the said court for that purpose, should

 

by a good and sufficient deed or deeds, convey to the

 

said Horatio C. Scott, his heirs and assigns forever,

 

in fee simple, the house and lot of ground in the said

 

proceedings mentioned, free and cleared from all or

 

any right, title, claim or interest of said defendants,

 

or any of them; And whereas also, doubts are enter-

 

tained whether the said decree, and the deed to be exe-

 

cuted in pursuance thereof, will vest in the said Hora-

 

tio C. Scott, a clear and unincumbered title to said

 

house and lot, as against the said infant children of the

 

said Alexander and Caroline Mundell, or whether the

 

said court has jurisdiction to pass the said decree,

 

notwithstanding the co'nsent of all the parties thereto,

 

Now therefore for remedy thereof:

 

SECTION 1. Be it enacted by the General Assembly of

Decree of court confirmed

Maryland, That the decree passed by the Prince

 

George's County court, sitting as a Court of Equity,

 

on the second day of December, in the year eighteen

 

hundred and thirty-five, in a certain cau.se in Equity

 

then pending, in which Horatio C. Scott is complainant,

 

and John Hodges, Rebecca Hodges, Benjamin B. Hodges

 

and Mary his wife, Caroline Hodges, Benjamin Hodges,

 

John H. Mundell, Ann Rebecca Mundell, Thomas A.

 

Mundell,and Samuel Coe are defendants, and all the pro-

 

ceedings in said cause, be and the same are hereby made

 

and declared to be valid and effectual for all the purposes
