LAWS OF MARYLAND

CHAP. 126

all and any money Accruing in right of the said James

 

M, Briscoe, Mary A. Briscoe, Andrew J. Briscoe and

 

Lucy B, Briscoe, and of each and any of them, from

 

the estate of the said Susannah Bruner, I deceased, and

 

in the hands of her said executor or which shall here-

Conditions

after come into his hands; Provided, that the said

 

orphans court shall be satisfied that the said Mary

 

Briscoe, before the time the passage of such order,

 

has executed a bond or bonds as guardian for her said

 

children, in a penalty not less than ten thousand dollars,

 

and with sureties approved by said Scott county court,

 

and that said bond has been filed in the office of the

 

clerk of Scott county court.

Made valid

SEC. 2. And be it enacted, That payment to the said

 

Mary Briscoe, as such guardian as aforesaid, by said

 

Daniel Duvall, as such executor as aforesaid, under

 

the order of the said orphans court, of any money now

 

in his hands or which shall hereafter come into his

 

hands, accruing in right of the said minors or of any

 

of them, shall be a good and valid payment, and plea-

 

dable as such in any court of law or equity in the

 

State.

Release and re-

SEC. 3. And be it enacted, That whenever the said

ceipt

Daniel Duvall, executor as aforesaid, shall he pre-

 

pared to pay a final dividend on the estate of Susannah

 

Bruner as aforesaid, the said Mary Briscoe, guardian,

 

shall acknowledge a release receipt to the said Daniel

 

Duvall, executor as aforesaid, as soon as he shall in-

 

form her what the amount of the final dividend is,

 

which release receipt shall be acknowledged before one

 

of the judges of the judicial district, in which the sai4

 

Mary Briscoe lives, or before a justice of the peace in

 

and for Scott county, in the State of Kentucky, and

 

certified by the clerk of said county, and when so

 

acknowledged and certified, shall he received by the

 

register of wills for Frederick county, in the State of

Record directed

Maryland, and recorded in the orphans court of said

 

county, and the said release receipt shall be a full and

 

final release to said executor.
