RESOLUTIONS.

 

No. 107.

Passed Mar.13,1832

Resolution in favor of Joshua Sed wick.

 

Resolved by the General Assembly of Maryland, That

 

the treasurer of the western shore, be and he is hereby di-

 

rected to pay to Joshua Sedwick, or his order, the sum of

 

two hundred and eighty-nine dollars and eighty-four cents,

 

it being the amount over paid by him into the treasury.

Preamble and Resolution relative to the Chesapeake and

 

Ohio Canal Company.

 

WHEREAS, the progress, on the route selected of the Bal-

 

timore and Ohio Rail Road, one of the great works of in-

 

ternal improvement, in the success of which the state of

 

Maryland is deeply interested, has been suspended at the

 

Point of Rocks, on the left bank of the Potomac river, by

 

a decision of the court of appeals of this state, in favor of

 

the claim of the Chesapeake and Ohio Canal Company, to

 

the prior right of choice for the route and site of their Ca-

 

nal along the Potomac, which right of choice, the said Ca-

 

nal company have executed by choosing for the route and

 

site of the Canal, the said left bank of the river.

 

AND WHEREAS, the chief engineer of each of the said

 

companies, acting as commissioners under the direction of

 

the court of chancery, and at the mutual request of the said

 

companies, after making the necessary examination, sur-

 

veys and estimates, united in opinion and reported, that it

 

was practicable to construct both the contemplated works

 

through the narrow passes from a point below, but near the

 

Point of Rocks, to a point at the bridge which crosses the

 

Potomac, at Harpers' Ferry, by a reasonable increase of

 

expense; And whereas, it is represented to this General As-

 

sembly, that the Baltimore and Ohio Rail-road company are

 

willing to bear and pay the additional expense which will

 

be incurred by the the joint construction of the said Canal

 

and said Rail-road, from the Point of Rocks,at Harpers' Fer-

 

ry, conformably to the said Report; and the interest of the

 

state, and the public benefit will be greatly promoted by the

 

extension of the said rail-road, past the Point of Rocks to

 

the bridge, at Harpers' Ferry — Therefore,

 

Resolved by the General Assembly of Maryland, That

 

it be earnestly recommended to the president and directors
