CHAP. 202

quest each inquisition shall be taken,, by reason of opening
the said road, shall thereupon proceed to assess and value
the damages accordingly, and which inquisition shall be
final and conclusive on all parties, and be delivered over to
the said commissioners to be returned and recorded as part
of their proceedings.

Repeal.

Sec. 3. And be it enacted. That all such parts of the act,
to which this is a supplement, as are inconsistent with this
act, be and the same is hereby repealed.

 

CHAPTER 202.

Passed Mar. 3,1812

A supplement to an act, entitled, An act to authorise the levy
courts of Baltimore and Harford counties to build a bridge
over the Little Gun Powder Falls, at Lee's mill, on the
road leading from Baltimore to Belle Air.

Levy directed.

Be it enacted by the General Assembly of Maryland, That
the commissioners of Baltimore and Harford counties are
hereby authorised and required to levy on the assessable
property of said counties, (in equal proportions), at (heir
next annual levy, and cause to he collected and paid over to
the commissioners hereinafter named, the sum of eight hun-
dred dollars; four hundred dollars from each county, for the
purpose of erecting a Bridge over the Little Gun Powder
Falls, at Ralph S. Lee's Mill; and that Ralph S. Lee, of

Commissioners

Harford county, and William Dimmitt, of Baltimore county,
be, and they are hereby appointed commissioners to fix up-
on a site, and superintend the erecting of the same, and also
to contract with some person or persons for erecting of said
bridge, from whom they shall take bond in the name of the
state, with sufficient security, conditioned for the faithful
performance of said contract; which said bond shall be filed
at the discretion of the person taking it, in the clerks office

Notice

of either Baltimore or Harford county, first giving notice in
some newspaper printed in the city of Baltimore, and in
Harford county, for three successive weeks, of the day
they will receive proposals for building said bridge; and if
the said contractor shall violate the condition of his bond,

Contract

it shall be the duty of the commissioners of Baltimore and
Harford counties, to direct said bond to be put in suit; the
said suit to be endorsed at the instance and for the use of
the said commissioners; and the damages when recovered,
shall be paid in equal proportions to the said commissioners
for the use of their respective counties.
